Terms of Service

These Terms of Service ("Terms") govern your use of the Trality booking and scheduling platform (the "Service") provided by Trality Pty Ltd ("Trality", "we"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Trality provides software-as-a-service tools for service businesses to manage online bookings, schedules, payments, and customer communications.

2. Eligibility and accounts

  • You must be at least 18 years old and have the legal authority to enter into a contract.
  • You must provide accurate registration information and keep it current.
  • You are responsible for safeguarding your password and for all activity under your account.
  • You must notify us immediately if you believe your account has been accessed without authorisation.

3. Free plan

Trality offers a free plan with no time limit and no credit card required. The free plan includes a limited set of features (see our pricing page for current details). You can upgrade to a paid plan at any time to unlock additional features, and you can downgrade back to free without losing your data.

4. Subscription, billing, cancellation and refunds

Pricing and billing. Paid plans are billed in Australian Dollars (AUD) inclusive of GST. Subscription fees are charged in advance for each billing period (monthly or annually, depending on the plan you choose). Payments are processed by Stripe.

Auto-renewal. Paid subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date. By signing up to a paid plan you authorise Trality (via Stripe) to charge your nominated payment method on each renewal date until you cancel.

Free trials. If we offer a free trial of a paid plan, you must add a payment method to start the trial. We'll charge that payment method at the end of the trial period and your subscription will begin unless you cancel before the trial ends. We will tell you the trial end date at signup and email a reminder before the first charge.

Cancellation. You can cancel at any time from Settings → Billing in your account dashboard, or by emailing support@trality.com.au. Cancellation takes effect at the end of your current billing period — you keep access to paid features until then.

Refunds. Subscription fees are generally non-refundable. We do not provide pro-rata refunds for partial months or unused time after cancellation. Nothing in these Terms limits or excludes the consumer guarantees you are entitled to under the Australian Consumer Law, including refunds for services that fail to meet a consumer guarantee.

Failed payments. If a renewal payment fails we'll retry over several days and email you. If the payment still hasn't succeeded, paid features may be suspended until the balance is cleared. Your data is retained for at least 30 days after suspension so you can update your payment method and resume without loss.

Price changes. We may change subscription pricing with at least 30 days' notice by email and in-app. Your current billing cycle will be honoured at the existing price; changes take effect at the next renewal. You may cancel before the new price takes effect if you don't agree to it.

Payments to your clients. Where you use the Service to take payments from your own customers, those payments are processed via Stripe to your own Stripe account. Trality is not the merchant of record for those transactions — your relationship with Stripe and with your customers governs those payments, including tax invoices, refunds and chargebacks.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose.
  • Resell, lease, or sub-licence the Service without our written consent.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Send spam, unsolicited communications, or harmful content via the Service.
  • Interfere with or disrupt the Service's operation, security, or other users.
  • Use the Service to build, train, or operate a competing product.

6. Your data

  • You retain ownership of all data you submit to the Service ("Customer Data").
  • You grant Trality a limited licence to host, process, and display Customer Data solely to operate the Service for you.
  • You are responsible for ensuring you have the right to submit Customer Data, including any personal information of your customers.
  • You are responsible for handling your customers' personal information in accordance with applicable privacy laws.

7. Intellectual property

The Service, including all software, content, branding, and designs, is owned by Trality and protected by intellectual property laws. We grant you a limited, non-transferable, revocable licence to use the Service in accordance with these Terms. Nothing in these Terms transfers any intellectual property rights to you.

8. Privacy

Our Privacy Policy explains how we handle personal information. By using the Service, you agree to the practices described in the Privacy Policy.

9. Service availability

We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance, suspend, or modify features from time to time. Where reasonably possible, we will provide notice of planned maintenance.

10. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all warranties not expressly set out in these Terms. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.

11. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you may have under the Australian Consumer Law or other consumer protection laws that cannot be lawfully excluded or limited.

12. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from your use of the Service is limited to the fees you paid to us in the 12 months immediately preceding the claim. We are not liable for indirect, consequential, incidental, special, or exemplary damages, including loss of profits, revenue, data, or business opportunities.

13. Indemnification

You agree to indemnify and hold Trality harmless from any claims, losses, damages, or costs (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your Customer Data; or (c) your customers' use of your booking pages.

14. Termination

  • You may close your account at any time from the dashboard.
  • We may suspend or terminate accounts that breach these Terms or that we reasonably believe pose a security, legal, or financial risk.
  • On termination, your access to the Service ends and your data will be handled in accordance with our Privacy Policy.

15. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. We will notify account holders of material changes by email. Continued use of the Service after changes take effect means you accept the new Terms.

16. Governing law

These Terms are governed by the laws of Queensland, Australia. You and Trality submit to the non-exclusive jurisdiction of the courts of Queensland.
